We understand that circumstances may arise that require you to cancel your Booking. The following outlines our cancellation policy, including any applicable fees and conditions:

1. Cancellation by the Traveller:

If you need to cancel your Booking, please notify BetterTrip as soon as possible in writing. Cancellations are only effective once confirmed by Better Trip. Cancellation fees may apply based on the timing of your cancellation relative to the departure date and the specific terms of your booked package. The cancellation policy and associated fees are outlined at the time of Booking and may vary by tour, package, and the Supplier. Any non-refundable elements (such as certain flights, accommodations, or event tickets) may not be eligible for refund, regardless of cancellation timing.

2. Cancellation Fees:

60+ days before departure: A minimal cancellation fee may apply, covering administrative and third-party costs.

30-59 days before departure: A higher cancellation fee will apply, typically reflecting a percentage of the total Booking amount.

Less than 30 days before departure: The highest cancellation fee will apply, which may include up to 100% of the Booking amount.

3. Cancellation by BetterTrip:

In rare instances, BetterTrip may need to cancel a Booking due to unforeseen circumstances, such as Force Majeure events, low participant numbers, or safety concerns. In such cases, we will notify you as soon as possible and offer one of the following options:
  1. Transfer to an alternative tour or package of equal or greater value, if available.
  2. Transfer to an alternative tour or package of lesser value, with a refund for the difference in price.
  3. A full refund of the land-only portion of the tour (other non-refundable elements will not be included).

In the event of a Force Majeure event, BetterTrip reserves the right to modify, suspend or cancel all or part of the Booking without liability. A Force Majeure event includes, but is not limited to, acts of God, natural disasters, pandemics, government-imposed travel restrictions, war, terrorism, civil unrest, strikes, safety issues, or any other event beyond the reasonable control of BetterTrip.

Where a Force Majeure event prevents the Booking from being fulfilled, BetterTrip will not be obligated to provide a refund. However, at BetterTrip’s sole discretion, alternative arrangements such as rescheduling, travel credits or vouchers may be offered as a gesture of goodwill.

BetterTrip will not be liable for any additional costs, such as visa fees, airfare, or other expenses incurred due to cancellation.

By making a Booking, you acknowledge and accept that refunds will not be provided in the above circumstances unless otherwise required by applicable Australian Consumer Law or other Australian legislation.

4. Refunds:

If applicable, refunds will be processed within a reasonable timeframe and will exclude any non-refundable portions of the Booking, as well as any cancellation fees.

Refunds will be made to the original form of payment and may be subject to currency fluctuations if booked in a foreign currency.

5. Supplier Cancellations:

Certain services included in your Booking, such as flights, cruises, and specific excursions, may have their own cancellation policies. In these cases, the cancellation terms of the Supplier will apply in addition to BetterTrip’s policies.

We strongly recommend purchasing comprehensive travel insurance that covers cancellations, interruptions, and unforeseen events. BetterTrip is not responsible for any losses, fees, or expenses resulting from your cancellation that could otherwise potentially be covered by travel insurance.

No-Show Policy

Failure to appear for your scheduled Booking or any included activity, without prior notice to BetterTrip, will be considered a “no-show” and will result in the following conditions:

1. Non-Refundable:

No refunds or credits will be issued for any portion of the Booking, activity, or package that is missed due to a no-show. This includes any transportation, accommodations, excursions, or other services that were scheduled for that day or period.

2. Responsibility for Additional Costs:

If you wish to rejoin the Booking or continue with other components of your Booking after a no-show, any additional expenses (such as transportation, accommodation adjustments, or other fees) will be at your own cost, subject to availability.

3. Notification Requirement:

If you anticipate being delayed or unable to attend part of your tour, please notify BetterTrip as soon as possible. We will do our best to assist with alternative arrangements; however, additional costs may apply, and availability is not guaranteed.

We highly recommend securing travel insurance that covers trip interruptions and missed connections, as BetterTrip is not responsible for costs or losses incurred as a result of a no-show.

Limitation of Liability

BetterTrip is committed to providing safe, enjoyable, and high-quality travel experiences. However, by participating in a Booking with BetterTrip, you acknowledge and agree to the following limitations of liability:

1. Third-Party Providers:

Better Trip acts as an agent for the Supplier, who are independent of BetterTrip, and who provide accommodations, transportation, activities, and other products or services included in your Booking. We do not own, manage, control, or operate the Supplier. BetterTrip is not liable for any acts, omissions, negligence, or defaults of Supplier, nor for any injury, damage, loss, delay, or inconvenience caused by their services.

BetterTrip may help you communicate with your Supplier, but we will not be responsible for anything the Supplier does or does not do. We cannot guarantee that the Supplier will review your communication or take any requested action.

2. Unforeseen Events:

BetterTrip is not responsible for any direct or indirect losses or expenses due to unforeseen circumstances beyond our control, including but not limited to Force Majeure events (natural disasters, weather events, strikes, war, political instability), delays, or changes in transport schedules, or health emergencies. In such cases, any additional costs incurred are the traveller’s responsibility.

3. Personal Responsibility and Risk:

Participation in a Booking with BetterTrip is voluntary, and you acknowledge that travel involves inherent risks. You agree to accept full personal responsibility for any loss, damage, or injury that may occur, including those resulting from your own actions, health conditions, or the actions of other participants.

4. Health and Safety:

BetterTrip prioritises health and safety but cannot guarantee protection from all risks. You are responsible for assessing your physical fitness and understanding the safety requirements for the activities included in your tour. You are also responsible for consulting with your healthcare provider regarding vaccinations, medications, or precautions needed for travel.

5. Financial Losses:

BetterTrip is not liable for any financial losses you may incur, such as lost deposits, loss of enjoyment, unused services, missed connections, or other incidental expenses resulting from tour changes or cancellations due to circumstances beyond our control.

6. Limit of Financial Responsibility:

By making a Booking, you acknowledge and accept that the maximum aggregate amount that you may recover from BetterTrip (whether by way of damages or otherwise) is limited to the amount paid by you to BetterTrip.

BetterTrip will not be responsible for any indirect, consequential, or punitive damages arising out of or related to your Booking.

BetterTrip is not liable to make any payment (whether by way of damages or otherwise) for any claims made by you unless notice of a claim against BetterTrip is made by you to us within 12 months of the Booking being fulfilled.

You must take all actions reasonably available to you to reduce and otherwise mitigate the extent and amount of any claim made against BetterTrip by you.

These limitations are in place to ensure transparency regarding liability and responsibility, and we encourage all travellers to understand the potential risks and prepare accordingly.

Travel Insurance

BetterTrip strongly recommends that all travellers purchase comprehensive travel insurance to protect against unexpected events and potential risks that may arise before or during the tour. Travel insurance is essential for safeguarding your financial investment and well-being and should provide coverage for the following:

1. Medical and Emergency Expenses:

Insurance should cover emergency medical expenses, hospitalisation, and medical evacuation in case of illness or injury while traveling. Many destinations may not have medical facilities of the same standard as your home country, making emergency coverage crucial.

2. Trip Cancellation and Interruption:

Coverage should include protection against trip cancellation, interruption, or delays due to unforeseen events, such as illness, accidents, natural disasters, or other circumstances beyond your control. This coverage helps protect the non-refundable portions of your travel costs.

3. Baggage and Personal Belongings:

Insurance should provide coverage for lost, stolen, or damaged baggage and personal belongings, especially if carrying valuable items or essential documents.

4. Personal Liability:

Personal liability coverage is recommended to protect against legal liability for injury or damage to third parties or their property during your travels.

5. Adventure and High-Risk Activities:

If your Booking includes activities considered high-risk (e.g., water sports, hiking, or other adventure activities), ensure your insurance policy includes coverage for these activities, as standard policies may not cover them.

6. Verification of Coverage:

It is your responsibility to verify the adequacy and validity of your travel insurance policy, ensuring that it meets the specific needs of your Booking and destinations. BetterTrip does not review individual insurance policies and is not responsible for any gaps in coverage.

7. Proof of Insurance:

Some Bookings may require proof of travel insurance before departure. In such cases, you must provide a certificate of insurance or other documentation showing coverage details, including emergency contact information for your insurance provider.

BetterTrip is not liable for any costs, damages, or losses that may arise from your failure to obtain adequate travel insurance. By making a Booking with BetterTrip, you acknowledge that you understand the importance of travel insurance and accept responsibility for any expenses or losses that may occur due to lack of coverage.

Force Majeure

BetterTrip is not liable for any failure to perform its obligations, or for any delay in performance, due to circumstances beyond its reasonable control. These events, collectively referred to as “Force Majeure,” may include but are not limited to:

1. Events Covered:

Natural disasters (such as earthquakes, hurricanes, floods, fires), acts of war or terrorism, pandemics, epidemics, government-imposed travel restrictions, civil unrest, strikes, safety issues or other significant disruptions that prevent or severely impact the operation of tours.

2. Impact on Services:

In the event of a Force Majeure situation, BetterTrip reserves the right to make necessary changes to the tour, including alterations to itineraries, accommodations, transportation, activities, or other components of the tour as needed. These changes may be made without prior notice and could result in modifications, delays, or cancellations of part or all of the Booking.

3. Liability Waiver:

BetterTrip is not responsible for any loss, damage, or additional expenses you may incur as a result of Force Majeure events. This includes but is not limited to non-refundable costs such as airfare, visa fees, or other travel arrangements made outside of your tour package.

4. Alternative Arrangements or Refunds:

When possible, BetterTrip will make reasonable efforts to offer alternative arrangements or reschedule affected Bookings. If alternative arrangements are not feasible, any refunds provided will be at BetterTrip’s discretion and may be limited to the recoverable portion of your tour cost, excluding non-recoverable costs.

This Force Majeure policy is designed to clarify responsibilities in unforeseeable and uncontrollable circumstances and ensures transparency for travellers regarding potential risks and their impact on travel plans.

Applicable Law

These terms and conditions, along with any disputes or claims arising from or related to your Booking or participation in a tour with BetterTrip, shall be governed by and construed in accordance with the laws of the State of Victoria, Australia.

By making a Booking with BetterTrip, you agree to submit to the exclusive jurisdiction of the courts of Victoria, Australia, for the resolution of any disputes or claims.

If any provision of these terms and conditions is deemed invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.

Amendments to Terms and Conditions

BetterTrip reserves the right to update or modify these terms and conditions at any time. Any changes will be posted on the Website at https://bettertrip.com.au/terms, and will take effect immediately upon posting. An up-to-date version of these terms can always be accessed on the Website and will be provided to you upon written request.

By continuing to use our services after the updated terms have been posted, you are deemed to have accepted the amendments. We recommend reviewing these terms prior to travel to ensure you are familiar with the latest version.
