  • Terms and Conditions

By making a Booking, purchasing or participating in any products or services offered by Better Trip Travel (ABN 90 609 800 133) (“BetterTrip”), you confirm that you have read, understood, and agree to these terms and conditions, as well as any specific terms associated with each Booking as published on the relevant booking page. These terms and conditions take precedence over any prior agreements or understandings. The term “Website” refers to www.bettertrip.com.au, and “Booking” denotes the product or services ordered or purchased on the Website, including all its advertised features at the time of purchase.

Website Information

BetterTrip takes every precaution to ensure that information on our Website regarding destinations, bookings, and their components is accurate. However, some information is intended as a guide, and actual conditions on tour, including routing or accommodation, may vary. Booking or excursion itineraries may differ from descriptions in brochures or online due to local conditions, weather, or annual events. BetterTrip will make every effort to inform you of any significant changes prior to departure. Information on the Website is for informational purposes only and should not be regarded as advice. We recommend reviewing all components of a Booking before making a purchase. BetterTrip reserves the right to modify the Website content at any time without notice. Additionally, BetterTrip reserves the right, at its sole discretion, to restrict access to the Website, limit communication with us, or prevent Bookings for any reason and at any time. BetterTrip is not liable for any loss resulting from changes to our Website’s content, including interruptions or errors.

The Booking Contract

Your Booking is confirmed, and a contract is established once BetterTrip issues a written confirmation following receipt of the applicable payment. Please review your confirmation carefully and notify BetterTrip immediately if any information is incorrect or incomplete. Ensure that all names match exactly as stated in the relevant passport. To make a Booking, you must be at least 18 years of age and agree to provide complete, accurate, and up-to-date information to BetterTrip.

You agree to provide accurate and up-to-date email and contact details at the time of making the Booking and to promptly notify BetterTrip of any changes to this information. This ensures that we can communicate important updates, including itinerary changes, cancellations, or other time-sensitive notifications related to the Booking.

BetterTrip will not be held responsible for any issues arising from our inability to contact you due to outdated or incorrect contact details. It is your responsibility to ensure that our emails and communications are received and not marked as spam or junk mail.

When you make a Booking, BetterTrip provides the services required to secure the fulfillment of the Booking. The Booking will be provided by independent third-party suppliers who provide accommodations, transportation, activities, and other products or services included in your Booking (“Supplier”). We do not own, manage, control, or operate the Supplier. The Supplier will be solely responsible for the fulfillment of the Booking.

The availability of a booking on our Website is not a recommendation or endorsement of any Supplier or its products, services, facilities, vehicles, etc.

Booking On BehalF of Others

By making a Booking on behalf of other participants, you are considered the primary contact for all individuals included in that Booking. This designation makes you responsible for ensuring all payments are made, informing BetterTrip of any changes or cancellations, and keeping all participants in your party updated.

When making a Booking on behalf of others, you represent and warrant that you have obtained all necessary consents. You are also responsible for ensuring the accuracy and completeness of any information provided on behalf of other participants. BetterTrip will not be liable for any errors or omissions in the information submitted to make or to complete a Booking.

Prices

To secure a Booking, you may be required to pay a deposit or the full amount. The specific prices and payment terms for making or completing each Booking are clearly stated on the Website at the time that you make the Booking.

The applicable prices and payment terms for each Booking will be confirmed at the time of making the Booking.

Promotional campaigns or special offers with different terms may also apply from time to time.

Unless otherwise indicated, the quoted price will be for each person in a twin-share arrangement. The price for each Booking may be different for travellers who are travelling alone or in odd numbers. It is your responsibility to review the details of the Booking carefully before making a payment, as refunds may not be available, and cancellation fees may apply if you choose to cancel.

Booking prices published on our site are valid for a limited time and may change periodically. BetterTrip reserves the right to adjust the Booking prices or required deposit amounts at any time without notice, with such adjustments applicable to any Bookings made after the changes are implemented. If you booked prior to a price reduction, you are not entitled to a refund or adjustment of your deposit. Customers on the same Booking may have paid different amounts, and no refunds will be issued for any price difference.

BetterTrip reserves the right to correct any pricing errors, and to cancel or refuse Bookings listed at an incorrect price. This applies regardless of whether the Booking has been confirmed or payment has been processed. In the event of a cancellation due to a pricing error, any payment already made will be promptly refunded in full.

After making the Booking, the final amount due may vary based on factors such as customisations, additional requests, changes to travel arrangements, currency fluctuations, fuel surcharges, government taxes, levies, and increases in airfare (if included). This includes adjustments to the base price for the Booking as well as optional extras or upgrades, such as additional tours or pre-tour or post-tour accommodations. Optional extras added after the Booking is made will be charged at the current advertised price, subject to availability. If the cost of delivering the Booking increases materially between the time the Booking was made and the date of travel, BetterTrip reserves the right to adjust the final price, which will be reflected on your invoice.

Payments

Payments must be made in accordance with the specified deadlines outlined for each Booking at the time of reserving. If payment is not received by the stipulated due date, BetterTrip reserves the right to cancel your Booking immediately. In the event of cancellation due to non-payment, any deposits or partial payments made will only be refunded at BetterTrip’s sole discretion, and standard cancellation fees may apply. Reinstating a cancelled Booking, if permitted, may incur additional fees, and is subject to availability at the time of the request.

Payments made to BetterTrip may be subject to transaction fees, including fees for credit card or third-party payments. Any applicable fees will be disclosed at the time of payment. BetterTrip is not responsible for any fees or charges imposed by third parties or financial institutions, including those associated with credit card or other payment transactions. BetterTrip will not refund or reimburse any such fees charged by third parties or financial institutions in connection with payments made to BetterTrip.

Details Required For Booking

As a condition of making the Booking, you must provide the information requested by BetterTrip along with your final payment. Failure to supply the necessary information for air tickets, rail tickets, permits, or other inclusions may result in additional costs, fees, or losses, including forfeiture of those inclusions. If you fail to provide the required information, BetterTrip reserves the right to deem your Booking (or the relevant part of it) cancelled and may apply cancellation fees at its discretion. The specific information required will vary depending on the Booking and will be communicated to you during the booking process. BetterTrip is not responsible for any fees or issues that arise due to errors, omissions, inaccuracies, delays, or incomplete information provided by you.

Travel Documents

It is your responsibility to obtain and carry all necessary documentation and identification for entry, departure, and travel to each country or region for your Booking. This includes a valid passport, visas, permits, certificates (such as vaccination or medical certificates), and travel insurance as required by relevant government authorities. Your passport must be valid for at least six months beyond your expected date of return to Australia per your Booking.

You accept full responsibility for securing all required documents, visas, and permits prior to the start of your Booking and are solely responsible for any costs incurred due to missing, expired, or incorrect documentation. You agree to cover any loss or expense incurred by BetterTrip as a direct result of your failure to secure or carry the necessary travel documents.

BetterTrip will not be responsibility for applying or securing any required visas or travel authorisations required for you or any other participants on your Booking to travel. BetterTrip does not provide advice on specific travel documentation and makes no warranties regarding the accuracy or completeness of information on visas, vaccinations, climate, clothing, baggage, or special equipment requirements. You agree that BetterTrip is not liable for any errors or omissions in this information.

Tour Flexibility and Modifications

You acknowledge that the nature of tour travel requires flexibility and agree to allow BetterTrip and the Supplier(s) to make reasonable changes to products, services, or itineraries as necessary. Routes, schedules, accommodations, activities, amenities, and modes of transportation are subject to change without notice due to unforeseen circumstances or events beyond BetterTrip or the Suppliers’ control (including, but not limited to, Force Majeure events, illness, mechanical issues, flight cancellations, strikes, political situations, and entry or border restrictions).

No reimbursements, discounts, or refunds will be issued for services missed or unused after departure when such circumstances arise through no fault of BetterTrip, including cases where you are removed from a tour due to negligence or breach of these Terms.

Booking Changes

BetterTrip understands that travel plans can change. If you wish to make modifications to your Booking after it has been confirmed, please contact us as soon as possible. All change requests are subject to availability and applicable fees, which may vary depending on the nature and timing of the change.

1. Changes Before Final Payment

If you request a change before your final payment is due, we will make every effort to accommodate your request. Additional fees may apply based on the specific modifications requested.

2. Changes After Final Payment:

Changes requested after final payment may incur higher fees, as they may require adjustments with the Supplier, such as with third-party hotels, transportation providers, and local tour operators. Please note that certain components, such as flights or special events, may be non-refundable and non-changeable after confirmation.

3. Name Changes:

Name changes or corrections may be allowed depending on the policies of the Supplier. Any fees associated with name changes will be passed on to you, and Better Trip cannot guarantee the availability of this option.

4. Cancellation Due to Change Request:

If your requested changes cannot be accommodated, you may choose to retain your original Booking or cancel according to our standard cancellation policy. In the event of cancellation, standard cancellation fees will apply.

5. Responsibilities:

BetterTrip is not liable for any additional costs arising from changes made to your Booking, including but not limited to additional fees from the Supplier or changes in travel dates, accommodation, or transport availability.

We recommend making any desired changes as early as possible to ensure the best chance of accommodation and to avoid unnecessary fees.

Booking Cancellation

We understand that circumstances may arise that require you to cancel your Booking. The following outlines our cancellation policy, including any applicable fees and conditions:

1. Cancellation by the Traveller:

If you need to cancel your Booking, please notify BetterTrip as soon as possible in writing. Cancellations are only effective once confirmed by Better Trip. Cancellation fees may apply based on the timing of your cancellation relative to the departure date and the specific terms of your booked package. The cancellation policy and associated fees are outlined at the time of Booking and may vary by tour, package, and the Supplier. Any non-refundable elements (such as certain flights, accommodations, or event tickets) may not be eligible for refund, regardless of cancellation timing.

2. Cancellation Fees:

60+ days before departure: A minimal cancellation fee may apply, covering administrative and third-party costs.

30-59 days before departure: A higher cancellation fee will apply, typically reflecting a percentage of the total Booking amount.

Less than 30 days before departure: The highest cancellation fee will apply, which may include up to 100% of the Booking amount.

Please refer to the specific terms provided at Booking for detailed information on the cancellation policy for your Booking.

3. Cancellation by BetterTrip::

In rare instances, BetterTrip may need to cancel a Booking due to unforeseen circumstances, such as Force Majeure events, low participant numbers, or safety concerns. In such cases, we will notify you as soon as possible and offer one of the following options:
  1. Transfer to an alternative tour or package of equal or greater value, if available.
  2. Transfer to an alternative tour or package of lesser value, with a refund for the difference in price.
  3. A full refund of the land-only portion of the tour (other non-refundable elements will not be included).

In the event of a Force Majeure event, BetterTrip reserves the right to modify, suspend or cancel all or part of the Booking without liability. A Force Majeure event includes, but is not limited to, acts of God, natural disasters, pandemics, government-imposed travel restrictions, war, terrorism, civil unrest, strikes, safety issues, or any other event beyond the reasonable control of BetterTrip.

Where a Force Majeure event prevents the Booking from being fulfilled, BetterTrip will not be obligated to provide a refund. However, at BetterTrip’s sole discretion, alternative arrangements such as rescheduling, travel credits or vouchers may be offered as a gesture of goodwill.

BetterTrip will not be liable for any additional costs, such as visa fees, airfare, or other expenses incurred due to cancellation.

By making a Booking, you acknowledge and accept that refunds will not be provided in the above circumstances unless otherwise required by applicable Australian Consumer Law or other Australian legislation.

4. Refunds:

If applicable, refunds will be processed within a reasonable timeframe and will exclude any non-refundable portions of the Booking, as well as any cancellation fees.

Refunds will be made to the original form of payment and may be subject to currency fluctuations if booked in a foreign currency.

5. Supplier Cancellations:

Certain services included in your Booking, such as flights, cruises, and specific excursions, may have their own cancellation policies. In these cases, the cancellation terms of the Supplier will apply in addition to BetterTrip’s policies.

We strongly recommend purchasing comprehensive travel insurance that covers cancellations, interruptions, and unforeseen events. BetterTrip is not responsible for any losses, fees, or expenses resulting from your cancellation that could otherwise potentially be covered by travel insurance.

No-Show Policy

Failure to appear for your scheduled Booking or any included activity, without prior notice to BetterTrip, will be considered a “no-show” and will result in the following conditions:

1. Non-Refundable:

No refunds or credits will be issued for any portion of the Booking, activity, or package that is missed due to a no-show. This includes any transportation, accommodations, excursions, or other services that were scheduled for that day or period.

2. Responsibility for Additional Costs:

If you wish to rejoin the Booking or continue with other components of your Booking after a no-show, any additional expenses (such as transportation, accommodation adjustments, or other fees) will be at your own cost, subject to availability.

3. Notification Requirement:

If you anticipate being delayed or unable to attend part of your tour, please notify BetterTrip as soon as possible. We will do our best to assist with alternative arrangements; however, additional costs may apply, and availability is not guaranteed.

We highly recommend securing travel insurance that covers trip interruptions and missed connections, as BetterTrip is not responsible for costs or losses incurred as a result of a no-show.

Health, Fitness and Accessibility

You confirm that you have a basic level of physical fitness and mobility, sufficient to manage uneven surfaces, climb stairs, and board boats as required. BetterTrip reserves the right, at its discretion, to request additional information or professional medical opinions if necessary to ensure your safety and the safe operation of the tour.

BetterTrip also reserves the right to deny you permission to travel or participate in any part of a tour at any time, at your own risk and expense, if it determines that your physical or mental condition renders you unfit for travel or poses a risk to yourself or others.

Pregnancy is considered a medical condition and must be disclosed to BetterTrip at the time of making the Booking. Due to safety concerns or any restrictions imposed by a Supplier, BetterTrip may refuse to partially or fully fulfill a Booking for participants who are over 24 weeks pregnant or those with certain medical conditions if reasonable accommodations or alternatives cannot be arranged.

If you fail to provide the requested medical information, BetterTrip reserves the right to cancel your Booking, in which case standard cancellation fees will apply.

You are responsible for determining if the Booking is suitable for your physical, mental, emotional and other ability and health. We recommend consulting your physician to confirm your fitness for travel and participation in the planned activities, and to seek advice on vaccinations and medical precautions. BetterTrip does not provide medical advice. You are responsible for evaluating the risks and requirements of each aspect of the Booking based on your personal health, limitations, fitness level, and medical needs.

Please note that travel with BetterTrip may involve visiting remote or developing areas where medical care may not be readily available, and medical facilities may not meet the standards of those in your home country. BetterTrip makes no representations or warranties regarding the availability or quality of medical facilities in the regions visited.

Age Requirement

To book and participate in a tour with BetterTrip, you must meet the following age requirements:

1. Minimum Age:

You must be at least 18 years old to make a Booking. For travellers under the age of 18, a legal guardian or responsible adult must complete the Booking and accompany the minor on the Booking.

2. Accompaniment of Minors:

Travellers under 18 must be accompanied by a parent, legal guardian, or a responsible adult at all times. Each adult may accompany only one minor. The accompanying adult assumes full responsibility for the minor’s behaviour and safety throughout the Booking.

3. Family-Friendly Tours:

Certain bookings may have specific age requirements based on the nature of the activities. These requirements will be clearly indicated in the booking description. BetterTrip reserves the right to refuse participation to any travellers who do not meet the specified age requirements.

4. Documentation:

Proof of age may be required at the time of Booking or at the start of fulfilling the Booking. Failure to provide valid proof of age may result in denial of participation without a refund.

These age requirements are in place to ensure the safety and enjoyment of all participants on our tours.

Special Requirements

BetterTrip strives to accommodate all travellers’ needs to the best of our ability. If you have any special requirements or requests, including but not limited to dietary restrictions, medical needs, or mobility assistance, please inform us at the time of making the Booking or as soon as possible before your departure. The following conditions apply:

1. Notification of Requirements:

It is essential that you communicate any special requirements to BetterTrip in advance. While we will make every effort to fulfill these requests, we cannot guarantee that all needs can be accommodated, particularly if notified at short notice.

2. Medical and Mobility Considerations:

If you have medical or mobility-related needs that may impact your participation in certain activities, please discuss these with BetterTrip prior to making the Booking. Certain tours may involve physical activities or may not be fully accessible to those with limited mobility. BetterTrip will assist in determining the suitability of a Booking based on the information you provide but reserves the right to deny participation if it may compromise your safety or that of other travellers.

3. Dietary Requirements:

We will do our best to request for the Supplier to cater to specific dietary requirements (such as vegetarian, vegan, gluten-free, or allergy-related diets) when possible. However, please note that options may be limited in certain destinations, and we cannot guarantee that all dietary preferences can be met. Travellers are advised to carry necessary medications for food allergies.

4. Additional Costs:

Some special requirements may incur additional charges, especially if the Supplier needs to make special arrangements. Any additional costs will be communicated to you, and payment will be required to confirm these arrangements.

5.Responsibility for Personal Needs:

Travellers are responsible for bringing any necessary medications, medical devices, or supplies required during the trip. BetterTrip cannot provide medical assistance or special equipment and is not responsible for any lack of accommodations related to uncommunicated needs.

6. Assistance for Companions:

If you require the assistance of a companion, you must make arrangements for a travelling companion to accompany you, as BetterTrip staff and Suppliers may not be able to offer one-on-one support.

Better Trip values inclusivity and aims to make travel as comfortable and accessible as possible. However, travellers are responsible for assessing their individual needs and communicating any requirements to us in a timely manner.

Optional Activities

Better Trip may offer optional activities or excursions as part of your travel experience. These activities are not included in the Booking and are subject to the following terms:

1. Participation and Fees:

Participation in optional activities is entirely voluntary. If you choose to participate, you may be required to pay additional fees. These fees are typically collected at the time of booking the optional activity or on-site at the activity venue.

2. Availability:

Optional activities are offered based on availability and may be subject to minimum participation requirements. BetterTrip cannot guarantee that all optional activities will be available on every tour.

3. Third-Party Providers:

Optional activities may be operated by third-party providers. BetterTrip acts solely as an agent for these providers and assumes no responsibility for the actions, services, or safety standards of these independent operators. The terms and conditions of the third-party provider will apply to your participation.

4. Risks and Safety:

You acknowledge that participation in optional activities involves inherent risks. BetterTrip strongly recommends that you assess your physical ability and any personal health or safety concerns before participating. It is your responsibility to ensure that you meet any fitness or safety requirements for each optional activity.

5. Non-Refundable:

Fees for optional activities are generally non-refundable once booked. Any cancellations or changes may be subject to the cancellation policies of the third-party provider, and BetterTrip cannot guarantee any refund for missed or unused activities.

This policy on optional activities ensures transparency and safety, while providing travellers with flexibility and choice.

Shopping

As part of the travel experience, you may have the opportunity to participate in group shopping for local specialty products that hold cultural and economic significance to the country’s heritage. There is no obligation to purchase any items. BetterTrip and its employees are not affiliated with these stores and are neither qualified nor permitted to guarantee the quality, value, or authenticity of any goods purchased, nor the suitability of any retail outlets visited.

You acknowledge that purchasing goods and using a credit card for such transactions involves certain risks. Any purchases made are at your own discretion, and BetterTrip is not responsible for any incidental expenses or consequential losses resulting from shopping purchases.

Limitation of Liability

BetterTrip is committed to providing safe, enjoyable, and high-quality travel experiences. However, by participating in a Booking with BetterTrip, you acknowledge and agree to the following limitations of liability:

1. Third-Party Providers:

Better Trip acts as an agent for the Supplier, who are independent of BetterTrip, and who provide accommodations, transportation, activities, and other products or services included in your Booking. We do not own, manage, control, or operate the Supplier. BetterTrip is not liable for any acts, omissions, negligence, or defaults of Supplier, nor for any injury, damage, loss, delay, or inconvenience caused by their services.

BetterTrip may help you communicate with your Supplier, but we will not be responsible for anything the Supplier does or does not do. We cannot guarantee that the Supplier will review your communication or take any requested action.

2. Unforeseen Events:

BetterTrip is not responsible for any direct or indirect losses or expenses due to unforeseen circumstances beyond our control, including but not limited to Force Majeure events (natural disasters, weather events, strikes, war, political instability), delays, or changes in transport schedules, or health emergencies. In such cases, any additional costs incurred are the traveller’s responsibility.

3. Personal Responsibility and Risk:

Participation in a Booking with BetterTrip is voluntary, and you acknowledge that travel involves inherent risks. You agree to accept full personal responsibility for any loss, damage, or injury that may occur, including those resulting from your own actions, health conditions, or the actions of other participants.

4. Health and Safety:

BetterTrip prioritises health and safety but cannot guarantee protection from all risks. You are responsible for assessing your physical fitness and understanding the safety requirements for the activities included in your tour. You are also responsible for consulting with your healthcare provider regarding vaccinations, medications, or precautions needed for travel.

5. Financial Losses:

BetterTrip is not liable for any financial losses you may incur, such as lost deposits, loss of enjoyment, unused services, missed connections, or other incidental expenses resulting from tour changes or cancellations due to circumstances beyond our control.

6. Limit of Financial Responsibility:

By making a Booking, you acknowledge and accept that the maximum aggregate amount that you may recover from BetterTrip (whether by way of damages or otherwise) is limited to the amount paid by you to BetterTrip.

BetterTrip will not be responsible for any indirect, consequential, or punitive damages arising out of or related to your Booking.

BetterTrip is not liable to make any payment (whether by way of damages or otherwise) for any claims made by you unless notice of a claim against BetterTrip is made by you to us within 12 months of the Booking being fulfilled.

You must take all actions reasonably available to you to reduce and otherwise mitigate the extent and amount of any claim made against BetterTrip by you.

These limitations are in place to ensure transparency regarding liability and responsibility, and we encourage all travellers to understand the potential risks and prepare accordingly.

Travel Insurance

BetterTrip strongly recommends that all travellers purchase comprehensive travel insurance to protect against unexpected events and potential risks that may arise before or during the tour. Travel insurance is essential for safeguarding your financial investment and well-being and should provide coverage for the following:

1. Medical and Emergency Expenses:

Insurance should cover emergency medical expenses, hospitalisation, and medical evacuation in case of illness or injury while traveling. Many destinations may not have medical facilities of the same standard as your home country, making emergency coverage crucial.

2. Trip Cancellation and Interruption:

Coverage should include protection against trip cancellation, interruption, or delays due to unforeseen events, such as illness, accidents, natural disasters, or other circumstances beyond your control. This coverage helps protect the non-refundable portions of your travel costs.

3. Baggage and Personal Belongings:

Insurance should provide coverage for lost, stolen, or damaged baggage and personal belongings, especially if carrying valuable items or essential documents.

4. Personal Liability:

Personal liability coverage is recommended to protect against legal liability for injury or damage to third parties or their property during your travels.

5. Adventure and High-Risk Activities:

If your Booking includes activities considered high-risk (e.g., water sports, hiking, or other adventure activities), ensure your insurance policy includes coverage for these activities, as standard policies may not cover them.

6. Verification of Coverage:

It is your responsibility to verify the adequacy and validity of your travel insurance policy, ensuring that it meets the specific needs of your Booking and destinations. BetterTrip does not review individual insurance policies and is not responsible for any gaps in coverage.

7. Proof of Insurance:

Some Bookings may require proof of travel insurance before departure. In such cases, you must provide a certificate of insurance or other documentation showing coverage details, including emergency contact information for your insurance provider.

BetterTrip is not liable for any costs, damages, or losses that may arise from your failure to obtain adequate travel insurance. By making a Booking with BetterTrip, you acknowledge that you understand the importance of travel insurance and accept responsibility for any expenses or losses that may occur due to lack of coverage.

Force Majeure

BetterTrip is not liable for any failure to perform its obligations, or for any delay in performance, due to circumstances beyond its reasonable control. These events, collectively referred to as “Force Majeure,” may include but are not limited to:

1. Events Covered:

Natural disasters (such as earthquakes, hurricanes, floods, fires), acts of war or terrorism, pandemics, epidemics, government-imposed travel restrictions, civil unrest, strikes, safety issues or other significant disruptions that prevent or severely impact the operation of tours.

2. Impact on Services:

In the event of a Force Majeure situation, BetterTrip reserves the right to make necessary changes to the tour, including alterations to itineraries, accommodations, transportation, activities, or other components of the tour as needed. These changes may be made without prior notice and could result in modifications, delays, or cancellations of part or all of the Booking.

3. Liability Waiver:

BetterTrip is not responsible for any loss, damage, or additional expenses you may incur as a result of Force Majeure events. This includes but is not limited to non-refundable costs such as airfare, visa fees, or other travel arrangements made outside of your tour package.

4. Alternative Arrangements or Refunds:

When possible, BetterTrip will make reasonable efforts to offer alternative arrangements or reschedule affected Bookings. If alternative arrangements are not feasible, any refunds provided will be at BetterTrip’s discretion and may be limited to the recoverable portion of your tour cost, excluding non-recoverable costs.

This Force Majeure policy is designed to clarify responsibilities in unforeseeable and uncontrollable circumstances and ensures transparency for travellers regarding potential risks and their impact on travel plans.

Images and Marketing

By participating in any Bookings, you acknowledge that images, photos, or videos may be taken by other participants, BetterTrip, or its representatives that may include your likeness. You consent to the capturing of such images and grant BetterTrip, its contractors, sub-contractors, and assigns, a perpetual, royalty-free, worldwide, and irrevocable license to use these images for any purpose, including marketing, promotions, and the creation of promotional materials, in any medium now known or developed in the future, without any further obligation or compensation to you.

You are not allowed to monitor, copy, scrape/crawl, download, reproduce or otherwise use anything on our Website for any commercial purposes without written permission from BetterTrip.

Indemnity

By participating in a Booking with BetterTrip, you agree to indemnify, defend, and hold harmless Better Trip, its affiliates, directors, officers, employees, agents, and contractors from and against any and all claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising out of or in connection with:

1. Personal Actions:

Any act, omission, or negligence on your part during the tour, including but not limited to, non-compliance with local laws, safety guidelines, or the terms and conditions of BetterTrip.

2. Third-Party Claims:

Any claims made by third parties arising from your conduct or actions during the tour that cause harm, injury, or loss to other individuals or their property.

3. Violation of Terms:

Any breach of these terms and conditions or any other policies and agreements you agree to by Booking with BetterTrip.

4. Financial Liabilities:

Any additional costs, charges, or expenses incurred as a result of your actions, such as damage to accommodations, loss or theft of property, or cancellation fees due to your failure to adhere to BetterTrip’s policies.

This indemnity extends to all claims, damages, losses, or expenses, whether direct or indirect, foreseeable or unforeseen, and includes liability for BetterTrip’s reasonable legal fees in defending against such claims. This provision shall remain in effect after the fulfillment of your Booking.

By making a Booking with BetterTrip, you agree to submit to the exclusive jurisdiction of the courts of Victoria, Australia, for the resolution of any disputes or claims.

Amendments to Terms and Conditions

BetterTrip reserves the right to update or modify these terms and conditions at any time. Any changes will be posted on the Website at https://bettertrip.com.au/terms, and will take effect immediately upon posting.
